KOTA KINABALU (Feb 26): An Indonesian man was sentenced to 10 years in prison and ordered to be given two strokes of the cane by the Sessions Court here for raping his underage girlfriend.
Judge Monica Linsua convicted the 30-year-old on his own guilty plea to a charge under Section 376(2)(d) of the Penal Code, which provides for up to 30 years’ imprisonment and whipping, upon conviction.
The offence was committed in a hotel room in Inanam on Dec 7, 2025.
According to the facts of the case, the complainant in the case filed a police report after being informed by the victim, 15, that she had engaged in sexual intercourse at the said hotel with her boyfriend ‘Boboy’, who was subsequently identified as the accused.
The court was told that the pair became acquainted with each other through TikTok and had been a couple for about a month.
In pleading for a lenient sentence, the unrepresented accused said he regretted his action and claimed that the girl had told him that she was 18 years old.
He also said as the eldest child in his family, he has many dependents to care for.
Deputy public prosecutor Nurul Shafeerah Mad Iskim pressed the court to impose a heavier sentence on grounds that the accused had committed a serious offence.
The DPP said even though the accused and the girl had engaged in consensual sex, the law clearly states that sexual intercourse with an underage person is an offence.
