Man in Kuching jailed 15 months for trespassing, hurting another with knife

KUCHING (Aug 9): The Magistrates’ Court here today sentenced a man to 15 months in jail for trespassing into a rented house at Kampung Masjid here and hurting its tenant with a knife.

Alphian Abdullah, 46, pleaded guilty before Magistrate Syarifah Fatimah Azura Wan Ali after a charge under Section 447 and Section 324 of the Penal Code was read to him.

The court sentenced him to one year in jail starting from today for the first charge under Section 324 of the Penal Code for hurting the 47-year-old tenant with a knife.

He committed the offence on the road in front of a hotel at Jalan Datuk Ajibah Abol near Kampung Masjid here around 10.30pm on Aug 4 this year.

For the second charge under Section 447 of the Penal Code, he was jailed for three months, starting from the date of his arrest Aug 5, for trespassing into the rented house.

Based on the facts of the case, the victim was in a room of the rented house before hearing his housemate yelling that someone had trespassed into the house compound.

The victim then exited his room and saw two men running away from the house’s compound.

He proceeded to chase the duo but only managed to catch Alphian in front of a hotel nearby.

A fight occurred between the victim and Alphian before the latter took out a knife and attacked the victim with it, injuring his stomach, back, cheek, and earlobe.

The victim was then sent to Sarawak General Hospital for treatment and a police report was lodged for further action.

Alphian was then arrested the next day and investigations found that the fight had been witnessed by a security guard who was in the area.

Insp Nur Shafiqa Nyaie Ilin prosecuted the case while Alphian was unrepresented.
