Miri hotel gets fines totalling RM3,000 for failing to rectify fire hazards

MIRI (April 7): The Magistrates’ Court here on Monday fined a hotel a total of RM3,000 for failing to comply with notices served by the Fire and Rescue Department (Bomba) to rectify identified fire hazards.

Magistrate Ashok Linggam convicted the hotel owner on his own guilty plea to two charges under Section 10 of the Fire Services Act 1988 (Act 341).

This Section carries a maximum fine of RM5,000, imprisonment of up to three years, or both, upon conviction.

According to the facts of the case, senior fire superintendent I Ahmad Nizam Sapaiee lodged a complaint on Jan 9, 2026 after the premises failed to comply with fire safety requirements despite two inspections conducted on April 15 and Sept 30, 2025.

Subsequently, an investigation paper was opened on Jan 27 and completed on Feb 26, confirming non-compliance with the directives issued.

The hotel management was imposed a fine of RM1,500 for each of the two charges, amounting to a total of RM3,000.

The magistrate further ordered an additional fine of RM100 per day for any continuing offence after conviction, should the premises fail to rectify the violations.

The prosecution was conducted by senior fire superintendent II Awangku Mohd Hazmin Awang Zainal with investigation officers deputy fire superintendent II  Zakaria Aini and senior assistant fire superintendent Alif Nasif, while the hotel owner was unrepresented by counsel.
