Miscarriage: Seek medical aid, avoid self-burial, SUPP tells public

KUCHING (March 3): The public is reminded to obtain immediate medical attention in the event of a miscarriage and to avoid handling a deceased foetus on their own, as such actions are punishable under Malaysian law.

Sarawak United People’s Party (SUPP) Public Complaints Bureau head Milton Foo issued the advice following a recent case in which he represented a 23-year-old woman sentenced for concealing the birth of a deceased foetus by burying it herself.

He said the woman, who was convicted under  Section 318 of the Penal Code, was fined RM4,000, in default six months’ jail.

The law provides for imprisonment of up to two years, a fine, or both.

“This was an accidental miscarriage, not a forced abortion.

“If she had called an ambulance and sought medical help, the legal consequences could have been avoided,” Foo said.

He stressed that immediate professional assistance is essential to ensure safety and compliance with legal procedures.

“The first step is to call an ambulance.

“Do not handle the foetus on your own. The law is very strict,” he added.

Foo, accompanied by lawyer Joanne Loy, called for greater public awareness, particularly among young women, on how to respond safely and legally in such situations.
