KUCHING (March 19): A resident at Lorong 2, Stampin Resettlement Scheme here has claimed that the Kuching South City Council (MBKS) issued her a notice over unauthorised roof structures that were erected by others.
Wishing to be known only as Boon, she said the notice instructed her to remove the structures, warning that failure to comply could result in a fine of RM250 per day and possible imprisonment.
Boon brought up the matter to Stampin MP Chong Chieng Jen’s special assistant Michael Kong, who pledged to write to MBKS seeking the withdrawal of the notice.
“After carefully reviewing the matter and speaking with Boon, it is clear that she did not erect, authorise, or have any involvement whatsoever with the construction of these structures,” Kong said in a statement.
He noted that while Boon owns and occupies the house next to the structures, she neither uses them nor parks her vehicles underneath, keeping them instead within her own compound.
The structures, he said, were erected by other parties without her knowledge.
Kong raised concerns over MBKS’ investigation, saying enforcement must be based on proper verification of facts.
“It is unreasonable and unjust to require an innocent resident to demolish or remove structures which she neither erected nor occupies,” he said.
He described the notice as “clearly misdirected and without proper factual basis” and urged the council to redirect enforcement efforts toward the actual responsible parties.
“Local authorities must exercise their powers fairly and carefully, based on proper investigation. Residents should not be wrongly accused or burdened due to administrative convenience,” Kong added.
He stressed that councils must serve and protect public interests, not place blame on innocent residents without first establishing the facts.
