KUCHING (Sept 2): The Magistrates’ Court here today sentenced a 27-year-old woman to 50 months in jail for stealing a motorcycle as well as possessing 17.21 grammes of methamphetamine and drug abuse.
Nur Athirah Mohamad was charged under Section 379A of the Penal Code and Section 34 of the same Code for stealing a motorcycle.
For drug possession and drug abuse, she was charged under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 39(1) of the same Section and Section 15(1)(a) of the Act, punishable under Section 15(1) of the same Section respectively.
She was sentenced to jail for 15 months for stealing a motorcycle; 30 months for drug possession; and five months for drug abuse.
Magistrate Ling Hui Chuan ordered all the jail sentence to take effect from Sept 2.
Aside from Nur Athirah, her acquaintance Mohd Khairul Abdullah, 29, was also jailed for 15 months for stealing a motorcycle.
The duo committed the offence at a five-foot-way in front of a shop at Jalan Abell here at 8.29am on Aug 27, 2024.
According to the facts of the case, the motorcycle owner lodged a police report that his vehicle had been stolen at the aforementioned address and date. The estimated loss was RM11,000.
The police report eventually led to the duo’s arrest.
Investigations found the motorcycle seized from Nur Athirah and Mohd Khairul was the same one reported stolen, confirmed by the engine and chassis number.
There was also CCTV footage from the scene showing the duo stealing the motorcycle.
Meanwhile, for the drug possession offence, Nur Athirah was charged with possessing 17.21 grammes of methamphetamine at a flat at Jalan Ban Hock on Sept 30, 2022.
During a search conducted on her, the police found a transparent plastic packet containing crystallised substances, later revealed to be methamphetamine, inside her bag.
She was subsequently detained and ordered to undergo a urine test, which returned positive for amphetamine and methamphetamine.
All cases were prosecuted by Insp Nur Shafiqa Nyaie Ilin, while Nur Athirah was unrepresented by counsel.
