KUCHING, Dec 1: A company director accused of deceiving agents from the Social Security Organization (PERKESO) regarding the Employee Incentive Programme has been ordered by the Sessions Court to undergo mental health supervision at Hospital Sentosa.
Judge Steve Ritikos issued the order today after approving the application presented by Deputy Public Prosecutor from MACC, Nur Nisla Abdul Latif.
Nisla sought for the accused, Norulhuda Nawawi, 39, to be referred to Hospital Sentosa for examination due to suspected mental health issues.
In the case, Norulhuda, along with her father Nawawi Ibrahim, 70, who is also a company director, faces charges under Section 415 of the Penal Code, punishable under Section 417 of the Penal Code, read together with Section 34 of the Penal Code.
The offense carries a maximum penalty of up to five years’ imprisonment, a fine, or both.
Although Nawawi pleaded not guilty when the charges were read, Steve allowed him to be released on RM20,000 bail with two local sureties.
The judge also directed the case involving the two family members to be mentioned again on Jan 12, 2024.
According to the charges, Norulhuda and Nawawi dishonestly influenced PERKESO agents to channel RM178,200 into the account of Huda Enterprise.
This was done by approving 31 employee names listed in the Career Generator Data 1.0 for the Employee Incentive Program between Sept 22, 2020, and Jan 28, 2021, at Wisma PERKESO in Travilion Commercial Centre, Jalan Padungan.
In the same court session, Nawawi faced another charge for committing a similar offense between Sept 21, 2020, and Jan 14, 2021, involving the disbursement of RM177,200 into his company’s account.
The funds from PERKESO were intended for approving 31 employee names listed in the Career Generator Data 1.0 for the Employee Incentive Programme.
