KUCHING: A grasscutter was sentenced to 12 months’ imprisonment by the Magistrates’ Court on Tuesday (Sept 22) for breaking into a kopitiam with the intention of stealing property on the evening of National Day.
The 49-year-old Raziman Fitri Omar pleaded guilty when the charge was read before Magistrate Nursyaheeqa Nazwa Radzali.
He was charged under Section 457 of the Penal Code, which provides for imprisonment of up to five years and liability to a fine upon conviction.
Where the offence intended to be committed is theft, the imprisonment term may extend to 14 years, while for a second or subsequent offence, the offender may also be liable to a fine or whipping.
The court ordered Raziman to serve the sentence from the date of his conviction on Sept 21.
Raziman committed the offence at about 11.09pm on Aug 31 at a kopitiam near Bandar Baru Samariang, Jalan Sultan Tengah, where he broke into the premises belonging to the 44-year-old complainant.
The facts of the case revealed that the complainant, who is the owner of the kopitiam, discovered that the padlock securing the storage room had been pried open.
Upon inspecting the storage room, the complainant found that a microphone wire, a carpet and catering appliances were missing.
Police subsequently arrested Raziman following a report lodged by the complainant and seized the carpet during the arrest.
Investigation revealed that Raziman was a frequent customer at the kopitiam and had rented a unit on the second floor of the same building, while the complainant had been renting the building for the past 17 years.
CCTV footage recorded on Aug 31 showed Raziman breaking into the premises and taking a carpet from the storage room.
In a separate case before the same Magistrate, Raziman was sentenced to 10 months’ imprisonment for drug abuse after pleading guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952 (Act 234), punishable under Section 15(1) of the same Act.
He was also ordered to undergo police supervision for two years after completing his sentence.
Under Section 15(1)(a) of the Dangerous Drugs Act 1952, a person convicted of self-administration of a dangerous drug may be fined up to RM5,000 or sentenced to imprisonment for up to two years.
The charge stated that Raziman tested positive for amphetamine and methamphetamine on Sept 28, 2022 at about 2.41pm at the Narcotics Crime Investigation Division (NCID) here.
The facts of the case revealed that police arrested Raziman on suspicion of drug abuse, following which an initial urine test returned positive for amphetamine and methamphetamine.
The urine sample was subsequently sent to the Pathology Department of Sarawak General Hospital, which confirmed the presence of the said drugs, both of which are listed in the First Schedule of the Dangerous Drugs Act 1952.
The prosecution in both cases was conducted by Prosecution Officer Inspector Siti Radhiah Abdul Rahman while Raziman was unrepresented.
