In Kuching, 14-year-old sent to reform school for raping his disabled elder sister

KUCHING (Oct 3): The Magistrates’ Court here today sent a 14-year-old boy to Sekolah Tunas Bakti in Kota Samarahan for three years for raping his disabled 16-year-old sister.

Magistrate Mason Jaro Lenya Barayan meted out the sentence on the boy after reviewing the Welfare Department’s probation report.

The court also ordered for the boy to be placed under the supervision of the Child Welfare Team for one year after serving his sentence.

The teen was charged under Section 376(3) of the Penal Code, which carries a jail term of between eight and 30 years, and a minimum of 10 strokes of the rotan upon conviction.

Based on the facts of the case, on March 10, the victim’s father found that she was pregnant and immediately lodged a police report for further investigation.

The baby was born on April 12 and samples from the child and the boy were sent to the Chemistry Department for analysis.

A DNA comparison test was conducted and on May 13 it was confirmed that the boy was the baby’s father based on a probability of 99.99 per cent.

The boy was arrested on May 26.

The case was prosecuted by ASP Mohd Adzmei Ahmad, while the boy was unrepresented by legal counsel.
