SIBU: A youth was sentenced to five years in prison and a stroke of whipping by the Session Court here today (Sept 5) for a repeated drug abuse offence.
Yong Min San, 25, pleaded guilty to have committed the offence under Section 15(1) (a) of Dangerous Drug Act 1952 (Act 234) which is punishable under Section 39(C)(1) of the same Act which provides for a jail term of between five and seven years and liable to whipping of not more than three strokes, upon conviction.
The charge against him stated that he had self-administered dangerous drug of Amphetamine and Methamphetamine at Jalan Wawasan on July 11 last year at about 1.15 pm.
The charge further stated that he had been previously convicted for four similiar offences.
Sessions Court Judge Musyiri Peet accepted the accused’s plea of guilt and convicted him of the offence as charged.
According to the facts of case, on July 11 last year at about 1.15 pm, a police party led by ASP Bill Azman Unjar from Sibu District Police Headquarters arrested the accused at Jalan Wawasan, suspected of being involved in drug abuse activities.
An initial screening test for the accused urine was conducted using “Rapid Test” which was found to contain “positive” drugs.
The accused urine specimen was then sent to Pathology Department, Sarawak General Hospital for analysis.
Investigation outcome revealed that the urine specimen of the accused found to contain Amphetamine and Methamphetamine which were listed in the First Schedule of Dangerous Drug Act 1952.
Based on the registry of criminals, the accused has four previous convictions.
The case was prosecuted bt DPP David Bakit while the accused was unrepresented.
