2 men fined, jailed for assaulting acquaintance over wife’s outing

KUCHING, Dec 21: A husband and his friend were fined RM1,600 each and sentenced to four months in prison for assaulting a 29-year-old man, according to the verdict handed down by Magistrate Mason Jaro Lenya Barayan.

Mohd Shahiezy Saizatul Shamsuddin, 25, and his accomplice, Mohd Saiful Amri Karim, 28, were charged under Section 323 of the Penal Code read in conjunction with Section 34 of the same Act, which prescribes penalties of up to one year in prison, a fine of up to RM2,000, or both for those found guilty.

The incident occurred on Dec 15, at 7.19am at a commercial center in TT3, Jalan Cina Kota Sentosa.

The defendants pleaded guilty to jointly causing harm to the victim.

According to the case details, the two assailants attacked the victim with a rattan stick and a chair, causing injuries to the head, back, and legs.

Despite the victim’s attempts to defend himself, he sustained injuries and was taken to Sarawak General Hospital for medical treatment.

The subsequent police report led to the arrest of both Shahiezy and Saiful on Dec 17.

Investigations revealed that the root cause of the incident was the victim taking Shahiezy’s wife out without his knowledge, leading to Shahiezy’s dissatisfaction and anger.

The assault involved the repeated striking of the victim with a rattan stick and a plastic chair, causing lacerations on various parts of his body.

Medical reports confirmed extensive bruising and soft tissue injuries. Closed-circuit television (CCTV) footage corroborated the assault, capturing the two accused attacking the victim.

Both defendants chose not to be represented by legal counsel, and the prosecution was conducted by Inspector Nur Shafiqa Nyaie Ilin. — DayakDaily
