KUCHING, July 1: A 39-year-old unemployed man was sentenced to 15 years’ imprisonment and eight strokes of the cane by the Sessions Court today after being found guilty of deliberately running over a man with his car, an attack that left the victim permanently disabled.
Sessions Court Judge Musli Ab Hamid delivered the sentence after ruling that the prosecution had proven its case beyond reasonable doubt for the offence of causing grievous hurt under Section 326 of the Penal Code, following a full trial.
In his judgment, the judge said the defence had failed to raise any reasonable doubt against the prosecution’s evidence.
The prison term was ordered to run from the date of the accused’s arrest on July 17, 2023.
The court also declined to impose compensation, taking into account the accused’s financial situation. The judge noted that such an order would likely place an additional burden on his mother and family members.
The incident occurred at about 9pm on July 15, 2023, near the traffic lights at Taman Desa Wira, when the accused intentionally used his vehicle to inflict serious injuries on a 42-year-old man.
During the trial, evidence showed that the victim had been accompanying a friend who was searching for his wife after discovering her car parked outside a lodging house.
At about 8pm, they saw the accused leaving the premises and approaching the woman’s vehicle. Although the woman was not present, the victim’s friend approached the accused to ask about her whereabouts, but the accused drove off without responding.
The victim and his friend then trailed the accused along Jalan Batu Kawa until both vehicles came into contact near the Desa Wira junction.
When the accused stopped, the victim stepped out of his car, apparently intending to speak to him. The accused then reversed his vehicle, forcing the victim onto the roadside pavement.
The court heard that the accused subsequently drove directly towards the victim, striking his right leg and knocking him down. He then fled the scene after also reversing into the vehicle driven by the victim’s friend.
The victim sustained catastrophic injuries, including the amputation of one leg, resulting in permanent disability.
The prosecution, led by Deputy Public Prosecutor Asmawi Nur Haqim Mokhtar, called six witnesses, while the defence called two witnesses.
Deputy Public Prosecutor Chuah Kai Sheng appeared for the prosecution during sentencing, while the accused was represented by counsel Arthur Liang Dawat. — DayakDaily
