SIBU: A 42-year-old local man was sentenced to 14 days’ imprisonment and RM4,000 fine, in default, two months’ jail by the Magistrates’ Court here on Wednesday for committing two criminal offences.
Cheng Teck Huei, from Permai Jaya Timur pleaded guilty to the charges when they were read and explained to him through an interpreter.
He was indicted on the first charge of voluntarily obstructed a public servant, Nurhana Johari from discharging her duties and public functions as assistant health officer at a restaurant in Permai Jaya on Aug 17 at about 7.50 am.
Thus, he had committed an offence under Section 186 of the Penal Code which provides for an imprisonment term of up to two years or RM10,000 fine or both, upon conviction.
The second charge preferred against him stated that he had voluntarily caused hurt to Nurhana by throwing his mobile phone at her face at the same venue and time, thereby committed an offence punishable under Section 323 of the Penal Code which upon conviction, carries an imprisonment term which may extend to one year or RM2,000 fine or both.
Magistrate Romario Jonoi convicted the accused on his own plea of guilty to both charges, and sentenced him to seven days’ jail and RM2,000 fine, in default, one month’s jail for each charge.
However, he ordered the imprisonment sentences for both charges to run concurrently.
According to facts of the case, on Aug 17, at about 7.50 am, when Nurhana (complainant) with her team from Sibu Division Health Office were inspecting the restaurant in Permai Jaya, a local man scolded her and was uncooperative and refused to give his identity card to be checked.
The man identified as the accused person, got up from a dining table and headed to his car and ignored the complainant.
After the accused opened his car door, he threw his mobile phone at the complainant, which hit her face and left cheek.
The complainant then called the police and soon after, a police team arrived and arrested the accused at the restaurant and seized his mobile phone. A police report was subsequently lodged.
Police investigation revealed that at the material time, when the complainant was at the restaurant’s compound, the accused became angry with her and her colleagues, and obstructed her from carrying out her duty and threw his mobile phone at her.
During the incident, there is a CCTV camera recording which shown the action of the accused.
Cheng, who was not represented by a counsel, failed to pay the fine.
