RM4,000 fine for lorry driver who smashed woman’s windscreen following fender bender in Petra Jaya

KUCHING (March 24): The Magistrates’ Court here fined a 33-year-old man RM4,000 in default 10 months’ imprisonment for smashing the windscreen of a female driver’s compact car on Jalan Taman Sri Perkasa in Petra Jaya, here.

Magistrate Ling Hui Chuan convicted Darrel Rengga Batin on his own guilty plea to a charge under Section 427 of the Penal Code for committing mischief, causing damage or loss to property.

This Section carries a jail term of between one year and five years, or a fine, or both upon conviction.

The offence was committed at 3.14pm on March 16.

According to the facts of the case, the female car driver was attempting to exit a junction along the road when her vehicle was cut off by an orange lorry, which sideswiped her car from the left, resulting in scratches to the left-side bumper.

The lorry driver — later identified as Darrel — then approached the woman and hurled a hard object at her vehicle, which struck the windscreen and shattered it.

This resulted in losses amounting to RM430.

The victim subsequently lodged a police report, which led to Darell’s arrest.

The police investigation confirmed that Darell had committed the offence, with the incident captured on the victim’s dashcam.

Deputy public prosecutor Ahmad Fauzulutfi Suriani appeared for the prosecution, while Darell was unrepresented by legal counsel.
