KUCHING: A 19-year-old youth has been ordered by the Sessions Court to be placed at Henry Gurney School until he reaches the age of 21 for raping his underage girlfriend, who subsequently became pregnant.
Judge Iris Awen Jon made the order today after considering a social report on the youth prepared by the Social Welfare Department (JKM).
The youth had earlier pleaded guilty to a charge under Section 376(1) of the Penal Code for raping the victim, who was 14 years and 10 months old at the time of the offence.
He committed the offence in a bedroom at a house in a village in Batu Kawa between September and October 2025.
Based on the facts of the case, the complainant went to a health clinic on April 7 this year for a medical examination, where a medical officer confirmed that she was 23 weeks pregnant.
The doctor subsequently advised her to lodge a police report due to her underage pregnancy.
The complainant also told investigators that she had engaged in sexual intercourse with her boyfriend voluntarily.
Police arrested the youth on April 8 at a house in the same village.
Investigations revealed that the complainant and the youth had met through TikTok before entering into a relationship and frequently going out together.
Between September and October 2025, the youth brought the complainant to his house and invited her to have sexual intercourse with him.
Although she initially refused, she later agreed because she wanted to appease him after he became upset with her.
In January this year, the complainant realised that she had missed her periods for an extended period and bought a pregnancy test kit, which returned a positive result.
She subsequently informed her mother, who took her to a clinic for a medical examination.
Deputy Public Prosecutor Chuah Kai Sheng prosecuted the case, while the youth was unrepresented by counsel.
