Two women fined for public fight over affair

KUCHING: A 41-year-old woman was fined RM1,000, in default one week’s imprisonment, by the Magistrates’ Court here today for fighting with a 44-year-old woman over an affair involving the latter’s husband.

Magistrate Nureina Syafika Mohd Najib imposed the fine on Azia Taufek after she pleaded guilty to a charge under Section 159 of the Penal Code, punishable under Section 160 of the same Code.

Meanwhile, Noor Azizan Bokhari, 44, was fined RM200, in default one day’s imprisonment, after she also pleaded guilty to the charge under Section 159 of the Penal Code.

Section 159 of the Penal Code defines affray, while Section 160 provides for a punishment of up to six months’ imprisonment, or a fine of up to RM1,000, or both.

The court heard that both women committed the offence at about 10:00 pm on September 30 at a village near Jalan Muhibbah, where they fought in a public place and disturbed public peace.

The facts of the case revealed that the incident occurred after Noor Azizan discovered that her husband was having an affair with Azia.

During the incident, Noor Azizan approached Azia and hurled vulgarities at her before punching her in the face, causing swelling to her left cheek.

A police report was subsequently lodged for further action, while the Sarawak Islamic Religious Department (JAIS) was also informed of the incident.

Investigations revealed that both women had provoked each other prior to the meeting.

Although the meeting was intended to clear up the misunderstanding, the two women ended up fighting in a public place, disturbing public peace.

The incident was witnessed by several people, who saw both women fighting and causing a scene.

Deputy Public Prosecutor, Muhammad Aidil Akmal Sharidan appeared for the prosecution, while both accused were unrepresented.
