Unemployed man jailed seven months for 0.18g drug possession

KUCHING: A 40-year-old unemployed man was sentenced to seven months’ imprisonment by the Magistrates’ Court here today for possessing 0.18 gramme (g) of methamphetamine.

Affizul Jasmi pleaded guilty to the amended charge under Section 12(2) of the Dangerous Drugs Act 1952, which was read before Magistrate Nursyaheeqa Nazwa Radzali.

The court also sentenced him to three months’ imprisonment for administering himself with amphetamine and methamphetamine, an offence under Section 15(1)(a) of the same Act.

Both sentences are to run concurrently.

The court heard that police, acting on information, detained Affizul at a roadside near the Taman Arbi flats in Kuching at about 12:50 pm on June 18.

A team from the Kuching District Police Headquarters Narcotics Crime Investigation Division conducted a physical search on the accused.

During the search, police found a transparent plastic packet containing suspected crystallised drugs in the right rear pocket of Affizul’s dark blue jeans. The packet had a gross weight of 0.26g.

The seized item was subsequently sent to the Chemistry Department in Kuching for analysis on June 19.

A chemical analysis report dated September 3 confirmed that the packet contained methamphetamine weighing 0.18g net.

The court was also told that Affizul tested positive with amphetamine and methamphetamine at about 2:00 pm on the same day at the Kuching District Police Narcotics Crime Investigation Department office.

Both substances are listed under the First Schedule of the Dangerous Drugs Act 1952.

Affizul was subsequently taken into custody for further action.

Deputy Public Prosecutor, Nurul Aqila Morsalin, appeared for both of the prosecution, while Affizul was unrepresented.
