Boy, 16, charged with raping girlfriend jailed three years

KUCHING (Feb 10): A 16-year-old boy was sentenced to three years’ imprisonment after he pleaded guilty at the Magistrates’ Court here yesterday to two counts of raping his girlfriend.

The teenager entered the plea after the charges under Section 376(1) of the Penal Code were read out to him before Magistrate Ling Hui Chuan, who ordered the child offender to be detained separately from adult prisoners.

The accused was also ordered to be considered for educational programmes while serving his custodial sentence.

The magistrate also rejected an application by the accused’s counsels Tiong Ing Neng and Alex Kong for a stay pending an appeal.

According to the charges, the teenager committed the offences in a classroom of a school here and the end of 2024 and again in October 2025.

The facts of the case stated that the accused and the now 16-year-old victim, who were classmates, were involved in a romantic relationship.

In November 2025, the girl’s mother was called to the school by the senior assistant for student affairs, who had discovered a note in the two teenagers’ respective diaries documenting their sexual relationship.

When questioned, the victim admitted to having engaged in sexual intercourse with the accused on two occasions.

An obstetrics and gynaecology specialist later confirmed there were old tears in the victim’s hymen.

The accused reportedly had several disciplinary records that affected his academic performance.

Deputy public prosecutor Ahmad Fauzulutfi Suriani appeared for the prosecution.
