Brother jailed 15 years, caned for incestuous rape that let to sister’s pregnancy

KUCHING, March 5: A 25-year-old man was sentenced to 15 years’ imprisonment and five strokes of the cane by the Sessions Court today after admitting to raping his younger sister, which resulted in her pregnancy and the birth of a baby boy.

The accused, a final-semester Bachelor of Science student, pleaded guilty when the charge was read before Sessions Court Judge Musli Abdul Hamid.

According to the case facts, the matter came to light on Aug 15, 2025, when the 23-year-old woman sought treatment from a medical officer at around 10.30am for abdominal pain.

During the examination, the doctor discovered that she was in the late stage of pregnancy, estimated between 37 and 39 weeks. Upon questioning, the woman revealed that the child’s father was her elder brother.

The medical officer subsequently lodged a police report, leading to an investigation that culminated in the accused’s arrest in Kota Samarahan on Feb 28.

Investigations determined that the offence occurred at the family’s apartment in Matang on Nov 14, 2024.

The accused was charged under Section 376B of the Penal Code, which carries a jail term of 10 to 30 years and whipping upon conviction.

The prosecution was led by Deputy Public Prosecutor Asmawi Nur Haqim Mokhtar. The accused did not have legal representation. — DayakDaily
