KUCHING (July 9): The Magistrates’ Court here today fined a man to RM2,000 in default six months in jail for committing criminal trespass into a house last week.
Iswandy Jubi, 40, pleaded guilty before Magistrate Mason Jaro Lenya Barayan after being charged under Section 448 of the Penal Code which carries a jail term for up to three years or a fine up to RM5,000, or both.
Iswandy committed the offence at a house in Taman Riverview, Jalan Daya here at around 3am on July 5, 2024.
Based on the facts of the case, the complainant who was the tenant of the house, woke up from his sleep when he heard the house grille being opened. At the time, the house was unlocked as the complainant’s son had not yet return from work.
Upon seeing Iswandy entering the house, the complainant immediately pulled on Iswandy’s sling bag until it snapped, allowing Iswandy to flee. The complainant checked the bag and found Iswandy’s identity card and two bank cards.
A police report was lodged, leading to Iswandy’s arrest on the same day at around 4.40pm.
Investigations found that Iswandy had intentionally trespassed into the complainant’s house, and during the identification parade, the complainant fully recognised Iswandy.
The case was prosecuted by Insp Merylene Lindan Andrew Mang while Iswandy was unrepresented by legal counsel.
