Dalat man who raped 15-year-old niece gets nine years’ jail, four lashes

SIBU (Oct 15): The Sessions Court in Mukah today sentenced a 27-year-old man to nine years in prison and four strokes of the rotan for raping his teenage niece multiple times.

Judge Musyiri Peet convicted the man on his own guilty plea to a charge under Section 376(1) of the Penal Code.

The Section provides for a maximum 20 years in prison and caning upon conviction.

According to the charge, the man raped his 15-year-old niece between Dec 24, 2023 and Jan 1, 2024 at around 10pm in Dalat.

Based on the facts of the case, the complainant, who is a medical officer in Mukah, examined the pregnant victim on July 30, 2024.

The victim’s school had referred her to the clinic to confirm the pregnancy.

From the examination, the victim was confirmed to be 33 weeks pregnant and expected to deliver on Sept 17, 2024.

The victim said that early this year, she was forced by her uncle to have sex with him.

The victim said when she refused, her uncle dragged her to his room and raped her.

She said the first incident scared her and whenever she went back home, her uncle would rape her.

This occurred twice a month from January to July 2024, except in April when she was involved in a school sports meet.

The rapes would take place either at a farm or in her uncle’s room.

The uncle was arrested on July 31, 2024.

Deputy public prosecutor Mohamad Amirul Hakim Mohamad Zamri handled the prosecution, while the uncle did not have legal representation.
