Foreigner who overstayed to spend four months in Miri jail before deportation

MIRI (Sept 24): The Sessions Court here today sentenced an Indonesian man to four months in jail for overstaying in the country.

Judge Azreena Aziz, who convicted Deka, 19, on his own guilty plea also ordered for him to be referred to the Immigration Department for deportation upon the completion of his sentence.

Deka was charged under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, which provides for a fine of up to RM10,000, or imprisonment of up to five years, or both, upon conviction.

According to the facts of the case, Deka was detained on Sept 20 at around 12.30pm at an estate on the Pan Borneo Highway in Suai.

Upon inspection, he was found to be an Indonesian whose social visit pass had expired.

ASP Koay Kok Ping prosecuted the case while Deka was unrepresented by legal counsel.
