Indonesian man in Miri jailed five months for overstaying

MIRI (Sept 2): An Indonesian man was sentenced to five months in jail by the Sessions Court here today for overstaying in the country.

Judge Azreena Aziz, who meted out the sentence against Muh Fadly, also ordered for him to be referred to the Immigration Department for deportation upon completion of his sentence.

Muh was charged under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, which provides for a fine up to RM10,000 and imprisonment up to five years or both, if convicted.

According to the facts of the case, Muh was detained at around 5.10pm on Aug 28, this year during a check at a jetty in Sungai Baong, Krokop here, after he was suspected to be a foreigner.

Upon inspection, he was found to be an Indonesian whose social visit pass had expired.

ASP Koay Kok Ping prosecuted the case while Muh was unrepresented by a legal counsel.
