Matang uni student gets 15 years’ jail, five lashes for incest with sister

KUCHING (March 5): The Sessions Court here has sentenced a 24-year-old man to 15 years in prison and five strokes of the rotan for committing incest with his 23-year-old sister.

The incestuous relationship resulted in the birth of a baby boy.

Judge Musli Ab Hamid also ordered for the final-year public university student’s sentence to take effect from the date of his arrest on Feb 28.

The accused pleaded guilty to a charge under Section 376B(1) of the Penal Code for unlawful sexual intercourse with a close relative, an act prohibited under both civil and religious law.

The Section provides for between 10 years and 30 years in prison and includes mandatory caning.

According to the charge, the offence took place at a flat in Matang here on Nov 14, 2024.

Case facts revealed that around 10.30am on Aug 15, 2025, a doctor at a health clinic in the Kota Samarahan area received a 23-year-old victim complaining of abdominal pain.

An examination confirmed that she was 37 to 39 weeks pregnant.

Upon questioning, the victim admitted having sexual relations with the accused, who is her brother.

The doctor lodged a police report, which led to the brother’s arrest.

In mitigation, the unrepresented accused claimed this was his first offence and requested leniency.

He also informed the court that he was in the final semester of his bachelor’s degree.

Deputy public prosecutor Asmawi Nur Haqim Mokhtar urged the court to impose a deterrent sentence, highlighting the gravity of the offence and public interest.
