KUCHING (Feb 2): The Magistrates’ Court here has sentenced a 29-year-old man to a total of 25 months’ jail for punching his younger brother in the face and threatening to harm him further.
Magistrate Ling Hui Chuan convicted Mohd Muzzakhir Malik on his own guilty plea to two charges under the Penal Code.
Mohd Muzzakhir was sentenced to 12 months in prison under Section 506 for criminal intimidation with intent to cause grievous hurt and received another 13-month jail term under Section 323 read together with Section 326A of the same Code for voluntarily causing hurt.
Ling ordered both sentences to run from the date of conviction.
Section 506 carries a maximum imprisonment term of seven years, or a fine, or both, upon conviction, while Section 326A provides for a maximum prison term of one year, or a fine of up to RM2,000, or both.
The offences were committed at a house in Kampung Tanjung Bako here around 10pm on Jan 28.
Based on the facts of the case, the incident arose from an altercation between Mohd Muzzakhir and his 16-year-old brother over the use of a stand fan.
This led him to smash the fan, which led to a scuffle during which Mohd Muzzakhir punched his brother in the face and threatened him, saying: “I’ll break your skull tonight.”
This caused the teenager to feel anxious and fear for his safety.
One of their parents then lodged a police report, which led to Mohd Muzzakhir’s arrest.
A subsequent medical report confirmed that the victim suffered bruising over the left periorbital area and superficial abrasions on the right upper inner lip.
Deputy public prosecutor Ahmad Fauzulutfi Suriani appeared for the prosecution, while the accused was unrepresented.
