KUCHING: A 28-year-old man was sentenced to seven months’ imprisonment by the Magistrates’ Court here today (Sept 15) for damaging several household items belonging to his mother during an outburst.
Magistrate Nursyaheeqa Nazwa Radzali meted out the sentence to Mohammad Fitri Abdullah after he pleaded guilty to committing mischief under Section 426 of the Penal Code.
Section 426 provides for imprisonment for up to five years, or a fine, or both upon conviction.
The accused committed the offence by damaging a dustbin, flower pots, a small table and a table fan belonging to his 59-year-old mother.
The offence was committed at about 7am on Sept 10 at a house near Jalan Batu Kawa.
The court heard that the complainant had lodged a police report after the accused allegedly came out of his bedroom and suddenly became enraged, damaging the household items.
It was understood the incident caused the complainant to feel frightened and concerned for her safety, while the damage was estimated at about RM250.
It was also informed that similar incidents had allegedly occurred previously that the accused is under the influence of substance, although no police report had been lodged until this incident.
Police from the Kota Sentosa Police Station’s crime prevention patrol unit arrested the accused at the same address at about 10 am on the day of the incident.
The court was told that investigations found the accused had intentionally damaged the complainant’s property, resulting in the charge being brought under Section 426 of the Penal Code.
Prosecution officer Inspector Siti Radhiah Abdul Rahman appeared for the prosecution while the accused is unrepresented.
