Samarahan man who slapped 10-year-boy over punctured tyre jailed three months

KUCHING (March 17): A 47-year-old man was sentenced to three months in prison by the Samarahan Magistrates’ Court for slapping a 10-year-old boy over a punctured tyre.

Magistrate Shafiza Datu Abdul Razak Tready convicted Zaiden Amran on his own guilty plea to a charge under Section 323 of the Penal Code for voluntarily causing hurt.

The Section carries a jail term of up to one year, or a fine of up to RM2,000, or both upon conviction.

The offence was committed at Kampung Asajaya Ulu in Kota Samarahan at around 9.30pm on March 11.

According to the facts of the case, the victim’s younger brother told their father that the accused had slapped the victim.

When the asked why, the younger brother told his father it was because the victim had punctured one of Zaiden’s van’s tyres.

However, the victim strongly denied this and was supported by other witnesses present at the time.

A medical report later confirmed that the victim sustained bruises on his left cheek.

Investigations revealed that Zaiden had slapped the victim’s left cheek three times and attempted to tie his hands and feet to force him to reveal who had punctured the tyre.

Zaiden also lodged a police report and admitted slapping the victim three times, an act that was witnessed by a friend of the victim.

Deputy public prosecutor Mohd Fadzri Azham Zainudin appeared for the prosecution, while Zaiden was represented by lawyer Arthur Liang Dawat.
