KUCHING, March 5: The Magistrates’ Court here has ordered two separate teenagers to be sent to the Henry Gurney School for three years each after they pleaded guilty to charges of raping underage girls in two unrelated incidents.
In the first case, Magistrate Mason Jaro Lenya Barayan issued the order against a 17-year-old restaurant assistant today. The court’s decision followed the consideration of a social report on the teenager from the Social Welfare Department.
The teenager had pleaded guilty to two charges under Section 376(1) of the Penal Code for raping a 14-year-old girl. The offences occurred at a rented room in a shop lot along Jalan Bako in early and late August 2025.
According to the facts of the case, the victim, a Form Two student at a madrasah in a Petra Jaya village, confessed to her parents on Dec 25, 2025, that she had a boyfriend she met through TikTok.
Her confession, which included disclosing that they had engaged in sexual intercourse twice, came after her mother discovered inappropriate messages and content on her smartphone.
The victim’s father lodged a police report, leading to the suspect’s arrest on the same day. At the time of the arrest, the 17-year-old tested positive for ketamine in a preliminary urine screening. A subsequent hospital examination of the victim confirmed the presence of old tears in her hymen.
For the separate drug-related offence, the accused is still awaiting a social report from the Social Welfare Department, with a court date to be set later.
In a second case, a 16-year-old boy was also ordered to undergo three years of detention at the Henry Gurney School.
Magistrate Nursyaheeqa Nazwa Radzali made the order after considering the teenager’s social background report, with the teenager pleading guilty to a charge of statutory rape under the same section of the Penal Code.
The offence involved a 13-year-old girl who later became pregnant. The incident took place at a house in a village in Petra Jaya in June 2025.
According to the facts, the girl’s mother became suspicious on Dec 18, 2025, after noticing her daughter’s abdomen appeared enlarged. A clinic visit confirmed the 13-year-old was 27 weeks pregnant.
A police report was lodged, leading to an investigation and the arrest of the 16-year-old on Jan 9. Investigations revealed the two were in a relationship and had engaged in sexual activity on several occasions.
In addition to the detention order for the 16-year-old, the court directed his parents or guardian to visit him once every two months, as provided under Section 93(1) of the Child Act 2001.
Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan handled the prosecution in the first case, while the 17-year-old accused was not represented by legal counsel. — DayakDaily
