KUCHING, May 26: The Sessions Court in Semuja, Serian, sentenced a 32-year-old man to 51 years in prison and 24 strokes of the cane after he admitted to committing incest against his 11-year-old stepdaughter, who was later found to be pregnant.
The accused pleaded guilty to three charges framed under Section 376B(1) of the Penal Code, read together with Section 16(1) of the Sexual Offences Against Children Act 2017, before Judge Musli Ab Hamid.
For each charge, the court imposed 17 years’ imprisonment and eight strokes of the cane. The jail terms were ordered to run consecutively.
Apart from the custodial sentence, the court also ordered the man to undergo rehabilitation counselling during his imprisonment and placed him under police supervision for two years upon completing his sentence.
According to the charges, the offences took place at a house in Tebedu.
The first offence was said to have occurred in the living room of the house at about 4am on Jan 12 this year. The second incident allegedly took place in the victim’s bedroom at around 2.15am on Jan 19, while the third offence occurred at the same residence in March.
The abuse was uncovered after the girl visited a health clinic in Tebedu on May 14 after complaining of nausea and vomiting.
A medical officer who attended to the child carried out several examinations, including a urine pregnancy test, which returned positive. Further ultrasound scans confirmed that the victim was about eight weeks pregnant.
During interviews with the medical officer, the victim claimed that she had been sexually assaulted by her stepfather almost daily since March.
Following the revelation, a police report was lodged, and the accused was arrested later that day at about 6.25pm.
Investigations later established that the accused had sexual intercourse with the victim in three separate incidents in January and March this year, which medical examinations confirmed.
The prosecution was led by Deputy Public Prosecutor Asmawi Nur Haqim Mokhtar, while the accused was unrepresented by counsel. — DayakDaily
