KUCHING, July 31: Only media agencies are permitted to use the mascot and logo of Sukma Sarawak 2024 for the purpose of news reporting and coverage.

Sarawak Multimedia Authority (SMA) general manager Dato Anderson Tiong stated this in an official letter to Sarawak Public Communications Unit (Ukas) director Samuel Simon on granting permission to media agencies to use the logo and mascot of Sukma Sarawak 2024 without the need to submit an official request to the Authority.

This statement followed SMA’s press release yesterday (July 30), warning of legal action against the unauthorised reproduction and use of the Sukma Sarawak 2024 logo and mascot.

However, Tiong emphasised that the exemption does not extend to the commercial use of the designs by businesses on merchandise or trading purposes without proper authorisation.

Yesterday, SMA ordered individuals and entities to cease and desist any unauthorised use of the Sukma Sarawak 2024 logo and mascot immediately, warning of potential legal consequences for copyright infringement.

SMA identified instances of unauthorised use of the logo and mascot by certain parties, reminding the public that these designs are duly registered under Section 26B of the Copyright Act 1987 (Act 332).

Tiong reiterated that any unauthorised use constitutes an infringement of SMA’s intellectual property rights under the Act.

Unauthorised use includes, but not limited to, reproduction in any material form, performance, display, distribution to the public, making for sale or rent any infringing copy, and selling or offering for sale or rent any infringing copy.

Other infringements include distributing infringing copies, possessing infringing copies for non-private use, exhibiting infringing copies in public by way of trade, and making or possessing any device used for creating infringing copies. — DayakDaily
