Trespassing, attempted theft in Kuching charges get man 6 months in jail

KUCHING (July 5): A man found guilty of trespassing into a house with the intent to commit theft was sentenced to six months in jail by the Magistrates’ Court here today.

The sentence was imposed on Alex Ujai, 33, by Magistrate Syafirah Fatimah Azura Wan Ali after he pleaded guilty to the charge framed under Section 451 of the Penal Code.

According to the charge sheet, he was found trespassing into the house of a 58-year-old man (the complainant) at Jalan Stampin here, at 1.50am on July 1 this year.

Based on the case facts, the complainant discovered an unused old shop key on the floor near the parking area of his house at 7.40am on that day.

He also noticed that the front-passenger door of his car was open, and the inside of the vehicle was in a mess.

The complainant then reviewed his closed-circuit television (CCTV) recording, and identified Alex in the footage, seen holding a meat cleaver in the kitchen area and at the rear of his house.

The footage also showed Alex’s attempt to open the front sliding door of the house, but failed.

No items were reported missing by the complainant.

A police report was filed, and Alex was arrested on July 2.

Prosecuting officer Insp Ammarsoffi Yusoff prosecuted, while the accused was not represented by a lawyer.
