KUCHING (Aug 1): The Magistrates’ Court here today fined a 20-year-old man RM1,000 in default one month in jail after he pleaded guilty to dishonestly retaining a stolen motorcycle belonging to a 70-year-old man.

Magistrate Zubaidah Sharkawi imposed the fine on the accused after reviewing his social report presented by the Social Welfare Department.

The accused was charged under Section 411 of the Penal Code, which carries a jail term between six months and five years, and a fine, upon conviction.

Based on the facts of the case, the motorcycle owner’s son lodged a police report after finding the vehicle, which he had parked in front of Plaza Astana in Jalan Astana here, had been stolen at around 4pm on April 22, 2024.

The estimated loss was around RM1,000.

Police subsequently arrested the accused at Kampung Samariang Baru on May 3, 2024 and recovered a motorcycle.

Further investigation found that the recovered motorcycle’s chassis number matched that of the stolen motorcycle.

ASP Arman Ibrahim prosecuted the case while the accused was unrepresented by legal counsel.
